This notice explains what personal data Orbitable collects, the purposes for which we process it, and how you can exercise your rights.

Your privacy matters to Orbitable, which is why we've developed this Privacy Notice covering how we collect, use, disclose and protect your personal data when you use our website and our OrbiNet, OrbiTruck, OrbiTracker and EnergyMonitor platforms. We take your privacy as seriously as you do, and we only collect the information necessary to provide you with the best service.
Orbitable ("Orbitable," "we" or "us"), domiciled in Mexico, contact email contacto@orbitable.mx, is responsible for processing the personal data collected through this website, its contact forms, and its mobile and web applications, in accordance with Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protecci贸n de Datos Personales en Posesi贸n de los Particulares, "LFPDPPP"), its Regulations, and other applicable provisions in Mexico.
Registration in our applications. To open an account on Orbitable's platforms you must provide a valid email address and create a password; depending on the module, you may also register your name, company and job title. We do not expose your personal information to other users or make it available to third parties who could identify you without your prior consent.
Location information. Our OrbiTruck and OrbiTracker solutions are designed to show you where your vehicles, assets and equipment are. To do this, we collect location data from GPS installed in transport units, as well as from beacons, RFID tags and BLE readers physically placed on monitored assets. While the application or hardware is operating, it periodically transmits this location information to show you the current position and last known point of each unit or asset. This is one of the primary ways Orbitable helps you locate what matters to you, even when an asset is outside direct coverage range.
Operational telemetry data. Our OrbiNet and EnergyMonitor platforms collect infrastructure and electrical variables (network device availability, current, voltage, frequency, power, temperature) from our customers' industrial equipment. This information is treated as the customer's operational data and is only associated with an identifiable individual if the customer itself configures the system to link a piece of equipment, vehicle or shift to a specific operator or employee.
IP address and approximate location. If you use a computer, phone or other device to visit our website or help center, we may use that device's IP address to determine an approximate location, in order to provide you with a better support experience.
Application usage information. We track how and how often you use our Services, as well as certain information your device sends when using them (model, operating system, version, and the dates and times of your requests). We use this information to provide optimal support and to generate anonymous statistics that help us understand platform usage.
Orbitable primarily serves businesses. When a customer company uses our platforms to track its fleet, assets, operational staff or industrial equipment, Orbitable acts as the data processor for data that customer company collects from its own employees (for example, drivers or operators), and the customer company remains the data controller of that data with respect to its workers, in accordance with the LFPDPPP. Orbitable processes that information solely under the customer company's instructions and for the provision of the contracted service, and does not use it for its own purposes outside the contract.

We do not sell your personal data or share it with third parties for marketing purposes unrelated to Orbitable.
Cookies are small text files placed on your computer's hard drive or your mobile device's memory, if your browser is set to accept them. Like other online services, we use cookies and similar tools to collect and understand how you use our Services: to remember you when you return to the site, identify you when you sign in, authenticate your access, remember your preferences, personalize content based on your region, and provide specific technical support. We may also use them to measure site usage and run diagnostics that help us improve our products.
You can set your browser to warn you before accepting cookies, or to reject them altogether; keep in mind that some site or platform features may stop working correctly if you disable them. The cookies we use expire when you close your browser (session cookies) or after a set period of time (persistent cookies).
We may use third-party analytics services to collect non-identifiable information about how visitors, in aggregate, interact with our site and platforms. These services may use cookies or other technologies, paired with an IP address, to help us analyze traffic and improve the overall experience of our Services.
We may use and process your personal information, including location information, to prevent fraud, misuse, impersonation and other illegal activities or activities contrary to our terms of service.
Like any company, we may disclose your information to a competent authority, to Mexico's National Institute for Transparency, Access to Information and Personal Data Protection (Instituto Nacional de Transparencia, Acceso a la Informaci贸n y Protecci贸n de Datos Personales, "INAI"), or to third parties, when in our judgment it is necessary to: (i) comply with a law, regulation or authority order; (ii) protect someone's safety; (iii) address suspected violations of this Privacy Notice or our terms of service; (iv) investigate fraud or security issues; or (v) protect the rights and property of Orbitable, our employees, customers and the public.
If Orbitable is acquired by a third party, or if our assets are acquired as part of a merger, acquisition or asset sale, some or all of the information collected from or about you may be transferred to the acquiring third party as part of that transaction, which will be required to honor the terms of this Privacy Notice.
Under the LFPDPPP, you have the right to Access, Rectify, Cancel or Object (ARCO rights) to the processing of your personal data, as well as to withdraw at any time any consent you have given us. To exercise these rights, send your request to contacto@orbitable.mx including: (i) your full name and contact information; (ii) documents proving your identity or legal representation; (iii) a clear description of the right you wish to exercise; and (iv) any other information that helps locate your data. We will respond within a maximum of 20 business days, as provided by law, and if your request is granted, it will take effect within the following 15 business days.
If you believe your right to personal data protection has been violated, you have the right to file the corresponding complaint with the INAI.
If you would like us to delete your personal information, your location information and your account, contact us at contacto@orbitable.mx with your request. We will take steps to delete your information as soon as possible, although some of it may be retained in backups or historical records for as long as required by applicable law (for example, tax or contractual obligations).
Note that even after your personal information is deleted, location data associated with an active device, beacon or BLE tag may continue to be captured anonymously by other network readers while the physical device remains in operation; however, once your personal information is deleted, any new captures will no longer be associated with you. If you wish to decommission a physical device, contact us to learn about the corresponding disposal or reassignment process.
We implement technical, physical and administrative systems, applications and procedures to protect your personal information and reduce the risk of theft, damage, loss, unauthorized access, disclosure, alteration or use. However, no security measure can guarantee absolute protection; although we make reasonable efforts to protect your information, we cannot guarantee that our databases are immune to unlawful access, malfunction or other forms of misuse.
We may share information with technology infrastructure providers (cloud hosting, messaging, analytics, electronic invoicing) that help us operate the site and our platforms, who are contractually required to protect your information and use it only for the purposes assigned to them. When these providers store or process data outside of Mexico, we will take the necessary measures to ensure such transfer complies with the principles of the LFPDPPP and offers a level of protection comparable to this Privacy Notice.
Orbitable may update this Privacy Notice at any time to reflect changes in our practices or legal requirements. Any material change will be posted on this same page along with its update date, and will take effect twenty calendar days after publication, unless the law requires immediate application. If you disagree with a change, you may stop using our Services and request that we delete your personal information as described in Section 9 above.
Our Services are directed at businesses and at adults acting on their behalf; they are not directed at anyone under 18 years of age, and we do not knowingly collect personal information from minors. If we discover that we have collected personal information from a minor without appropriate consent, we will take steps to delete it from our records as soon as possible.
